Agency models tax Bali rent at 10% final. Article 26 takes 20% of the gross, and no document picks one

Article 26(2) switches the withholding off for disposals the final-tax article governs. Article 26(1), where rent sits, carries no exception at all — and the regulation that charges the 10% never mentions a non-resident.

The number

Not confirmed: no primary document we opened puts the 10% final rental tax on a non-resident landlord. Article 26(1) withholds 20% of the gross from a non-resident's rent and carries no exception clause. PP 34/2017 charges an individual or entity with no residence test and never mentions Article 26.

Every investment model this desk has seen for a Bali villa carries a tax line, almost always the same one. Government Regulation 34 of 2017 taxes income from letting land and/or buildings at 10% of the gross rental value, and its Article 4(2) defines that gross to include maintenance, security and service charges.Source: 4JDIH Kementerian Keuangan, Last reviewed Confidence: Verified The rate is quoted correctly.

What no document supports is the step taken after it: we have collected no published source applying that rate to an owner who is not an Indonesian tax resident. It reached this desk as an assumption inside spreadsheets, and we make no finding about how often, because we counted nothing.Unverified The income tax law has a provision addressed to that owner, on a base it never defines.

Which instrument taxes a foreign owner’s rent?

Both appear to, which is the problem. Article 26(1) — re-enacted in full by Article 111 item 2 of Law 6 of 2023 — withholds 20% “dari jumlah bruto”, of the gross amount, from income payable to a non-resident other than a permanent establishment. Its letter c reads “royalti, sewa, dan penghasilan lain sehubungan dengan penggunaan harta”: royalties, rent and other income connected with the use of property.Source: 1JDIH Kementerian Keuangan, Last reviewed Confidence: Verified

The regulation charging the lower rate does not exclude that owner either. Article 2(1) of PP 34/2017 charges its final tax on rent “yang diterima atau diperoleh orang pribadi atau badan” — received by an individual or an entity — with no residence qualifier anywhere in the charging clause.Source: 4JDIH Kementerian Keuangan, Last reviewed Confidence: Verified So the market’s figure is not textually excluded. It is unresolved, and the silence cuts both ways.

The connection is not there. Counted on the whitespace-flattened text of PP 34/2017, because its line wrapping produces false zeros: “Pasal 26” no times, “Wajib Pajak luar” no times, “subjek pajak luar” no times, against four occurrences of the control string “Pasal 4”. All three occurrences of “negeri” sit in Article 3(2) and qualify the payer.Source: 4JDIH Kementerian Keuangan, Last reviewed Confidence: Verified Nor does the implementing rule in force join them up. PMK 81 of 2024 never names PP 34/2017, and all four of its occurrences of “persewaan” concern serviced offices and aircraft or ships, against 80 occurrences of the control string “pengalihan hak atas tanah”.Source: 5JDIH Kementerian Keuangan, Last reviewed Confidence: Verified So the finding is a gap, not a rate: nothing we opened — instrument, circular, form or decision — says which regime taxes a non-resident’s Bali rent. A document we failed to find may exist; the counts and fetches behind this negative are named in the text.Unverified

Source Illustrative calculation by this desk from the rates in the instruments themselves: Article 4(1) of PP 34/2017, and Article 26(1) of the income tax law as re-enacted by Article 111 item 2 of Law 6 of 2023. Plotted figures are claim c24. Re-read when either instrument is amended, and rebuilt if any instrument, circular or decision states which of the two reaches a non-resident landlord. Note Not a measurement of the world. The bars set two instruments against each other, and no document we opened says which of them taxes a non-resident's rent. Both readings are illustrative, neither is a tax computation for any owner, no costs are deducted on either side, and no treaty rate is applied.

Why doesn’t the withholding switch off, the way it does on a sale?

Because the switch sits in one paragraph and not the other. The mechanism is not ours: our earlier piece on what tax a Bali leasehold sale bears ran this hinge for disposals, where it points the other way.

Article 26(2) withholds 20% of estimated net income on a non-resident’s sale or transfer of property in Indonesia, “kecuali yang diatur dalam Pasal 4 ayat (2)” — except what Article 4(2) governs.Source: 1JDIH Kementerian Keuangan, Last reviewed Confidence: Verified A final tax made under Article 4(2) turns that withholding off by its own terms. For rent there is nothing to turn off.

In the whole of Article 26 the word “kecuali” occurs exactly three times, in paragraphs (2), (4) and (5); paragraph (1), which carries rent, has none. We counted on the Law 6 of 2023 re-enactment and again on the Law 36 of 2008 text.Source: 1JDIH Kementerian Keuangan, Last reviewed Confidence: Verified

Article 26(1b), added by Law 6 of 2023, allows the 20% on the gross to be lowered by Government Regulation for the interest at letter b, and names no other letter.Source: 1JDIH Kementerian Keuangan, Last reviewed Confidence: Verified Where the legislature wanted room to reduce this rate it said so once, and not for rent.

The withholding is not permanent. Article 26(5) makes it final except on Article 5(1)(b) and (c) income and on income of a foreign person “yang berubah status menjadi Wajib Pajak dalam negeri atau bentuk usaha tetap” — whose status changes to domestic taxpayer or permanent establishment.Source: 1JDIH Kementerian Keuangan, Last reviewed Confidence: Verified Cross that line and the deduction becomes a credit against an assessment; how Indonesia counts the days that make you a tax resident is the other side of this provision.

Can a non-resident deduct what the villa costs to run?

This is the second leg. Article 6(1) determines taxable income “bagi Wajib Pajak dalam negeri dan bentuk usaha tetap” — for a domestic taxpayer and a permanent establishment — as gross income less the costs of earning, collecting and maintaining it. Item 2 of Chapter III of Law 7 of 2021 re-enacts that paragraph with the same opening words, rewriting the list of deductions that follows and not the class of taxpayer it addresses.Source: 3Direktorat Jenderal Pajak, Last reviewed Confidence: Verified A landlord who is neither is in neither class. The law does not forbid him the deduction; the article does not address him, which is all the text supports.

Article 111 of Law 6 of 2023 amends the income tax law as last amended by Law 7 of 2021, and contains exactly two items: Article 2 and Article 26. Articles 4, 6 and 32A are not among them.Source: 1JDIH Kementerian Keuangan, Last reviewed Confidence: Verified Article 26 is current beyond doubt through that re-enactment. Article 6 is current through the 2021 law instead, which is why we had to read it.

The first version of this piece reported that Law 7 of 2021 could not be retrieved. That was true of one host and not of the law: the ministry endpoint answered 500 on 14.10.2026, and on 20.10.2026 the tax authority’s own file host served all 224 pages.Source: 3Direktorat Jenderal Pajak, Last reviewed Confidence: Verified

One more difference decides whether anyone collects. Where the tenant is not a withholding agent, Article 3(3) of PP 34/2017 makes the tax “wajib dibayar sendiri” — payable by the recipient itself.Source: 4JDIH Kementerian Keuangan, Last reviewed Confidence: Verified Article 26 has no counterpart: “sendiri” occurs no times anywhere in it, in either text, against three occurrences of “dipotong”, withheld.Source: 1JDIH Kementerian Keuangan, Last reviewed Confidence: Verified It works only through a payer on its own closed list, and a foreign guest is not on it.

The case against this reading — where we may be wrong

Three arguments cut at us, and the first could make the piece wrong.

Lex specialis. A reader can argue that a final tax made under Article 4(2) is the special rule and displaces the general withholding, exception clause or none, and that Article 26(2)’s carve-out is belt and braces, not the only route. No instrument, circular or published decision we opened adopts that argument, and none rejects it.Unverified The asymmetry is in the text; we are not grading it as proof that the higher rate survives.

That the final regimes reach residents only. No primary text we read states that the Article 4(2) final regimes reach only resident taxpayers, or that Article 26 is the exclusive regime for a non-resident.Unverified It is the position most often assumed in practice, it would dissolve the overlap in a line, and we could not find it written down.

Treaty relief. The hook is not where the market puts it. Article 32A, re-enacted by item 9 of Chapter III of Law 7 of 2021, empowers the government to form and carry out tax agreements with partner jurisdictions for five listed purposes, among them the avoidance of double taxation. It is a power to conclude agreements, and states no rule giving one priority over Article 26 and no procedure by which a non-resident claims it.Source: 3Direktorat Jenderal Pajak, Last reviewed Confidence: Verified No treaty was read for this piece either, and we will not write treaty sentences without reading one.

What the paperwork assumes, we can say. Article 1 point 125 of PMK 81 of 2024 defines the certificate of domicile of a non-resident taxpayer, and Article 135(2) requires it, with treaty documents, to refund tax wrongly withheld from a non-resident.Source: 5JDIH Kementerian Keuangan, Last reviewed Confidence: Verified

Its attachment for income claimed under a double-taxation convention names at item 1 letter c “royalti, sewa, dan penghasilan lain dari penggunaan harta”, and asks for the agreement, the receipt journal, the bank statement and a notice of income computation.Source: 5JDIH Kementerian Keuangan, Last reviewed Confidence: Verified The ministry’s forms are built for a non-resident receiving rent on the Article 26 track.

The document a reader would have to comply with is the one we could not open. The tax authority’s copy of PER-25/PJ/2018, which sets out how treaty relief is applied, is a scan with no text layer: it runs 46 pages and yields 46 bytes of text, one page break per page and not one letter.Source: 6Direktorat Jenderal Pajak, Last reviewed Confidence: Verified We attempted no OCR, which is not a reading of a legal instrument, so this piece cannot tell a reader which form to file.

Two boundaries. Article 2(3) of PP 34/2017 takes income from lodging services and their accommodation out of the object of the rental tax altogetherSource: 4JDIH Kementerian Keuangan, Last reviewed Confidence: Verified — so a villa let by the night may not be inside the lower regime at all, and whether Article 1559 and the pondok wisata licence permit that letting is a separate question, as is Badung’s own tax on what a villa guest pays. Nothing we read defines Article 26’s “gross”, and we have not filled that silence from PP 34/2017.

What can an owner ask before the first rent is paid?

Ask the manager in writing which instrument it withholds under, at what rate, and for the withholding slip. The answer names the regime being applied to you, which is more than the documents do. On 100 units of gross rent the difference is 10 units against 20, and the second is taken before any cost is counted.Estimate

Ask who pays. If the rent arrives from a platform or a guest rather than an Indonesian company, nobody on Article 26’s list has touched it, and whether a self-payment duty arises is not a question this piece answers.

Then read the tax line in a projection as an assumption, not a figure. The yields quoted in villa marketing already price this deduction at the higher rate; a model pricing it at the lower one is choosing between two instruments the documents, as we read them, have not chosen between.
