If a nominee purchase is void, do you lose the land or the money as well

The market discusses nominee arrangements as a risk of losing the land. The 1960 statute says something narrower and harsher, in one sentence, and it has not changed in sixty-six years.

The number

Indonesian agrarian law voids any transaction meant to pass freehold title to a foreigner, directly or indirectly. The land goes to the state. The same sentence adds that payments already received by the seller cannot be reclaimed, while third-party charges on the land survive.

Nominee arrangements are usually described in the language of probability: risky, could be challenged, has been known to go wrong. The statute is not written in that language. It states a consequence, and the consequence has two halves that buyers rarely hear together.

Article 21(1) of the Basic Agrarian Law of 1960 reserves hak milik — full freehold title — to Indonesian citizens.Source: 1JDIH Kementerian Perumahan dan Kawasan Permukiman, Last reviewed Confidence: Verified That is the premise every nominee structure is built to work around: the land is held in an Indonesian name, and a stack of private agreements is meant to make the foreigner the real owner.

Article 26(2) addresses exactly that stack. A sale, exchange, gift or bequest intended to transfer hak milik to a foreigner, directly or indirectly, is void by operation of law; the land falls to the state; the rights of other parties encumbering it continue; and all payments already received by the owner cannot be reclaimed.Source: 1JDIH Kementerian Perumahan dan Kawasan Permukiman, Last reviewed Confidence: Verified

Read the last two clauses next to each other. The bank that lent against the land keeps its security. The buyer who paid for the land keeps nothing — not the land, because it went to the state, and not the money, because the statute says it cannot be demanded back. The party protected by the sentence is the creditor, not the payer.

Two boundaries, so this is not read as more than it is.

The first is what the article covers. It voids transactions aimed at transferring freehold. The common Bali structure is not drafted as a transfer of freehold: it is a lease plus a bundle of powers of attorney. Whether a particular bundle amounts to an indirect transfer is a question a court answers about that bundle, and we are not in a position to tell you how a court would rule on yours. We can tell you the rule that would then apply.

The second is inheritance. A foreigner who comes to hold hak milik through inheritance without a will, or through the mixing of marital property, has one year to give the right up; after that the right lapses by law and the land goes to the state.Source: 1JDIH Kementerian Perumahan dan Kawasan Permukiman, Last reviewed Confidence: Verified That is the same outcome arriving by a slower road, and it catches families who never intended to structure anything.

We read the statute in the copy published by the legal-documentation office of the housing ministry, as it stood on 8 September 2026. It has been in force since 1960 and this part of it has not been amended, which is worth saying plainly: unlike most of what this journal covers, the answer here does not depend on the current regulation cycle.

What we are not publishing: how often this happens. Indonesian court decisions on nominee cases exist and are cited in academic writing, but the Supreme Court’s decision database refused our requests, so we have not read a single judgment ourselves. A number about enforcement would be a number we cannot source, and this piece would rather end short than end with one.
