Paying for a Bali villa in dollars risks 1% of the price, and no escrow in Indonesian law holds the money
The currency law makes the rupiah compulsory for payments made inside Indonesia. The only deposit the Civil Code offers sits with a court and can be withdrawn by whoever put it there, and the notary statute gives a notary no power to hold a buyer's funds at all.
The number
Indonesia's Law 7/2011 requires the rupiah in every payment made inside the country. A non-cash breach of that rule carries an administrative payment of 1 per cent of the transaction value. Indonesian law offers no escrow: the Civil Code's only deposit sits with a court, and the depositor may take it back.

A seller sends bank details over a messaging app. The agent says a remittance service is faster than a wire. A third voice says to bring the cash to the notary’s office. All three are answers to the same question, asked in public as a choice between rails.Unverified The documents answer a different question first: what the money may be at the moment it changes hands, and who is allowed to hold it until then.
Must a Bali villa be paid for in rupiah?
Yes, if the payment happens inside Indonesia. Article 21(1) of Law 7 of 2011 on currency requires the rupiah in every transaction with a payment purpose, in the settlement of other money obligations, and in other financial transactions carried out in Indonesian territory.1JDIH Kementerian Keuangan, Last reviewed Article 21(2) lifts that duty for five things only: certain state-budget transactions, grants from or to abroad, international trade transactions, foreign-currency deposits at a bank, and international financing.1JDIH Kementerian Keuangan, Last reviewed
The third is where a villa sale gets argued into an exception. Article 8(1) of Bank Indonesia Regulation 17/3/PBI/2015 defines an international trade transaction as the export or import of goods across the Indonesian customs territory, or services crossing a border by cross-border supply or consumption abroad.2Bank Indonesia, Last reviewed A plot in Pererenan crosses no customs border. That the sale therefore falls outside the exception is our reading of the two provisions together; neither says it.
The regulation binds every party in cash and non-cash transactions alike, was promulgated on 31 March 2015, and brought the non-cash duty into force on 1 July 2015.2Bank Indonesia, Last reviewed The money may arrive in dollars and sit in dollars, because a foreign-currency bank deposit is one of the five exceptions1JDIH Kementerian Keuangan, Last reviewed , while the payment may not be made in them. Article 11 obliges a business actor to quote prices in rupiah only, and Article 19 makes the sanction a written warning.2Bank Indonesia, Last reviewed A dollar price list is thus the agency’s own breach, on our reading, and says nothing about a private seller.
Can the contract simply say the price is in dollars?
The statute reads as though it can, and the regulation says it cannot. Article 23(1) forbids anyone to refuse rupiah tendered in payment, and Article 23(2) excepts foreign-currency payment agreed in writing.1JDIH Kementerian Keuangan, Last reviewed But Article 10(3) of the regulation allows such a written agreement only for transactions already exempt under Articles 4 and 5, or for strategic infrastructure projects approved by Bank Indonesia.2Bank Indonesia, Last reviewed
Older paper sits differently: written foreign-currency payment agreements made before 1 July 2015 run to their end, for non-cash transactions only, and any extension or amendment falls under the regulation.2Bank Indonesia, Last reviewed A dollar-priced lease from 2014 is no precedent for a contract signed today.
Being wrong costs differently by rail. Article 18 answers a non-cash breach with a written warning, an obligation to pay, and a ban from payment traffic, and fixes the payment at 1 per cent of the transaction value, capped at IDR 1,000,000,000.2Bank Indonesia, Last reviewed A cash breach is criminal instead: Article 33(1) carries confinement of up to 1 year and a fine of at most IDR 200,000,000, Article 33(2) the same for refusing rupiah, and Article 41(1) classes both as pelanggaran rather than kejahatan.1JDIH Kementerian Keuangan, Last reviewed
The rate Bank Indonesia published for 5 October 2026 was IDR 17,917.00 per USD.13Bank Indonesia, Last reviewed On this publication’s reference object, a two-bedroom Canggu villa, USD 400,000 is IDR 7,166,800,000: the 1 per cent payment comes to IDR 71,668,000, or USD 4,000, and the ceiling is nowhere near. The criminal ceiling of IDR 200,000,000 is USD 11,163.Estimate Settling wrongly by wire costs a percentage of the deal; settling wrongly in cash is a criminal matter with a much smaller maximum fine.
Does the transfer itself get reported, and from what size?
Bringing the money in is free, and the reporting around it is mostly not yours to file. Article 2(1) of Law 24 of 1999 lets every Resident freely own and use foreign exchange, Article 2(2) subjects domestic use to the legal-tender rules, and Article 1(3) defines a Resident by domicile, actual or intended, of at least one year.3JDIH Kementerian Keuangan, Last reviewed Holding and spending are governed separately.
Regulation 21/2/PBI/2019 does reach individuals: it names them among reporters, requires a monthly report by the 15th of the following month, and sanctions a late or missing one with a written warning.4Bank Indonesia, Last reviewed The statute above it is harsher on paper, since Article 6 of Law 24 of 1999 punishes an intentional refusal to supply foreign-exchange data with a fine of IDR 250,000,000 to IDR 1,000,000,000.3JDIH Kementerian Keuangan, Last reviewed What an individual must actually file is sent onward to an implementing regulation we did not obtain.
The thresholds that bite sit with the counterparties. Article 18(3) of Law 8 of 2010 triggers know-your-user checks at a transaction worth at least IDR 100,000,000.5JDIH Kementerian Keuangan, Last reviewed Article 23(1) has a financial services provider report suspicious transactions, cash transactions of at least IDR 500,000,000 in a working day, and all fund transfers from and to abroad, their reportable size left to a PPATK regulation.5JDIH Kementerian Keuangan, Last reviewed Article 17(1)(b) names a property company or agent first among the other reporting businesses, item 16 of Article 17(1)(a) names a money-remittance operator among the financial ones, and Article 27 requires the agent to report a client transaction of at least IDR 500,000,000 within 14 working days.5JDIH Kementerian Keuangan, Last reviewed
At the published rate the check threshold is USD 5,581 and the agent’s reporting threshold USD 27,906, so the reference villa at IDR 7,166,800,000 is over fourteen times the size at which a report is due.Estimate A remittance service is no way around that, because the operator is a reporting party itself. The rail changes who files, not whether anyone does.
Cash is worse. Article 34(1) requires cash or bearer instruments of at least IDR 100,000,000 carried into or out of the customs area to be declared to the Directorate General of Customs and Excise, which reports to PPATK within 5 working days; Article 35(1) fines a failure at 10 per cent of the whole amount carried, capped at IDR 300,000,000, and Article 35(3) takes it from the cash itself.5JDIH Kementerian Keuangan, Last reviewed On the reference villa that tenth is IDR 716,680,000 before the cap, and the cap is USD 16,744.Estimate
Is there escrow, and can the notary hold the money?
Not in the western sense, and the notary’s own statute is the evidence. Article 15 of Law 2 of 2014 states the notary’s authority as a closed list: drawing and keeping authentic deeds, fixing their date, issuing copies, certifying signatures and private documents, advising on a deed, drawing land deeds and auction minutes, with Article 15(3) leaving further authority to other legislation.8JDIH Kementerian Keuangan, Last reviewed Article 16(1) then lists fourteen duties, lettered a to n, every one documentary or procedural.8JDIH Kementerian Keuangan, Last reviewed Custody of purchase money is in neither list. Reading a closed list for what it omits is inference, and Article 15(3) is a door we cannot see through.
The money-laundering rules, oddly, assume the practice exists. Article 3 of Government Regulation 43 of 2015 made notaries and land deed officials reporting parties alongside advocates and accountants, and Article 4 obliged them to run know-your-user checks.6JDIH Pusat Pelaporan dan Analisis Transaksi Keuangan, Last reviewed Government Regulation 61 of 2021 replaced its Article 8, so the professions now report transactions done for a client where the assets are suspected proceeds of crime, in five categories including the purchase and sale of property, the management of money, and the management of current, savings and deposit accounts.7JDIH Pusat Pelaporan dan Analisis Transaksi Keuangan, Last reviewed A notary managing client money is named in Indonesian law as a risk to be reported, and nowhere as a service the notary is empowered to provide. The contrast is ours to draw, and it is the sharpest finding here.
What the Civil Code does offer is a deposit, and it is not escrow. Article 1404 lets a debtor whose creditor refuses payment tender the cash and then deposit it with the court, which discharges the debt and counts as payment if done lawfully.10Kejaksaan Negeri Sukoharjo, Last reviewed The notary’s part is to make and record the tender with two witnesses, while the money goes to the custody office at the registry of the court that would hear the dispute.10Kejaksaan Negeri Sukoharjo, Last reviewed And Article 1408 lets the depositor take it back until the creditor collects.10Kejaksaan Negeri Sukoharjo, Last reviewed
A deposit the payer can withdraw secures nobody.
That clause ends the escrow reading on its own. A deposit the payer can withdraw secures nobody: it is a remedy against a seller who will not accept money, not a hold released against a title that has moved. Anything escrow-like here is therefore a contract, and Article 1338 gives an agreement the force of law between those who made it while Article 1340 confines it to them, so it neither binds nor benefits a third party10Kejaksaan Negeri Sukoharjo, Last reviewed — not the land office, not the tax office, not whoever later claims the certificate. If that claimant is the risk being priced, the readings that matter are whether a void nominee purchase takes the money with it and whose consent a transfer needs when the thing sold is a lease.
At what moment is it safe to release the money?
There is no moment at which money and title cross. The documents sequence the other way. Article 3(1) of Government Regulation 34 of 2016 requires the seller’s income tax on the transfer to be paid before the deed is signed, Article 3(5) lets the authorised official sign only against a tax payment slip researched by the tax office, Article 3(7) names the land deed official among those officials, and Article 7 has the land ministry register a transfer only where the application carries that slip.11JDIH Kementerian Keuangan, Last reviewed Article 2(1)(a) sets that tax at 2.5 per cent of the gross transfer value.11JDIH Kementerian Keuangan, Last reviewed
The buyer’s own tax runs earlier: Article 49(a) of Law 1 of 2022 fixes the moment BPHTB falls due, for a sale, on the date the binding sale and purchase agreement is signed, and Article 47(1) caps the rate at 5 per cent, the number left to a regional regulation.12Direktorat Jenderal Perimbangan Keuangan, Kementerian Keuangan, Last reviewed On the reference villa the income tax is IDR 179,170,000, or USD 10,000, payable before any deed exists, and BPHTB at the statutory ceiling would be IDR 358,340,000, or USD 20,000, due at signature of the binding agreement.Estimate Which tax and which rate reach a given structure is a separate question, read twice already: what rate applies when a Bali leasehold is sold, and whether acquisition tax is due on someone else’s lease.
So the answer has an honest shape. A buyer pays into an irreversible sequence, and the protection has to be built from the deed stages and the certificate checks rather than from a third party holding the cash — and only the check your own land deed official orders counts.
What to ask before signing
Five questions, all answerable in writing and from documents.
Which account does the purchase money land in, and in whose name? The answer is the seller’s account or some person’s private account, because the notary’s statutory powers offer no third option.
Who files which report, and when? The agent’s duty under Article 27 runs on a threshold and a fourteen-working-day clock, the bank’s and the remittance operator’s under Article 23, and the notary’s on suspicion rather than size. None is discharged by you.
Will the rupiah clause be in the deed, with the conversion named — who converts, at which bank, on which published rate? The duty sits on both sides of the table.
Can the researched tax payment slip be produced before the deed, not after? Article 3(5) makes it the condition on which the official may sign at all, so a seller who cannot produce it is saying the deed cannot be signed.
If cash crosses a border, who declares it to the Directorate General of Customs and Excise? The declaration is the cheap step, and the penalty is a tenth of the sum carried, taken out of the cash.
Where we may be wrong, and the case against this reading
There is a serious argument on the other side, and it is about the hierarchy of norms rather than about any figure here. A statute outranks a central-bank regulation. Article 23(2) of Law 7 of 2011 permits a written foreign-currency clause in plain terms and attaches no conditions to it; the narrowing to exempt transactions and strategic infrastructure appears only in Article 10(3) of the regulation. A lawyer could argue that the regulation cannot cut down what the statute grants, and that a written dollar clause therefore stands. We think the better reading is that Article 23 governs only the prohibition on refusing rupiah while Article 21 carries the obligation to use it, and that Article 21 has no written-agreement exception at all. That distinction is ours, not the statute’s, and we have found no decision testing it.
Five further limits bound everything above.
We read documents, not practice. What a Bali notary office, a bank branch or the Badung land office does with a dollar-denominated contract is not in these texts, and we read no body of cases.
The part a reader most wants closed is the part we could not close. The scope of an individual’s own foreign-exchange report is sent on by Regulation 21/2/PBI/2019 to a Peraturan Anggota Dewan Gubernur, and the reportable size of a cross-border transfer by Article 23(3) of Law 8 of 2010 to a PPATK regulation. We obtained neither. Anyone stating the exact figure at which an inbound transfer becomes reportable is not reading those two documents.
We checked the currency law for amendments and found one. Article 10 of Law 4 of 2023 amends Law 7 of 2011 in four points only — Article 2, Article 11, a new Article 14A and Article 19, all of them about digital rupiah — and Articles 21, 23 and 33 are not among them.9JDIH Kementerian Keuangan, Last reviewed We read that section rather than a consolidated text, and we could not establish whether the 2015 Bank Indonesia regulation has itself been amended, because the central bank publishes it without a status panel.
Two copies are imperfect. The Civil Code has no authoritative Indonesian text at all, the authentic act being the Dutch original, so every Indonesian version is a translation and ours is hosted by a prosecutor’s office. The 2021 amending regulation has damaged font mapping, printing its own year as 2O2T and Pasal 1 as Pasal I; the five categories survive that, being lettered and repeated in the explanatory section, and we read both.
Four national portals refused us while we worked. peraturan.bpk.go.id answered HTTP 403 on 10 October 2026, as did dpr.go.id, and jdihn.go.id and peraturan.go.id did not answer within thirty seconds. Nothing here rests on a copy from any of them. The rest we read on 10 October 2026 in the copies the finance ministry’s legal portal, Bank Indonesia and the financial intelligence unit publish themselves, with the Civil Code as noted, and for the acquisition-tax articles in the ministry’s own copy of Law 1 of 2022 rather than the one registered against that source. The occupancy assumptions behind the reference villa are argued separately, in the piece on marketed yields.
