The government's own KEK page offers 80 years of hak pakai. PP 40/2021 Pasal 142 grants 30

Every facility in the framework that touches a dwelling is written for a tourism zone, and the one article addressed to a purchase requires that buying the dwelling be the zone's designated Main Activity — a determination we could not find published for either Bali zone.

Indonesia's special-economic-zone framework gives its corporate tax holiday only to a business investing in the zone's designated Main Activity. Two provisions mention buying a dwelling, both inside a tourism zone, and one of them requires the purchase itself to be that Main Activity. We located no published determination of the Main Activity for either Bali zone.

Bali now has two special economic zones, both in Kota Denpasar, and a listing inside either one arrives with a bullet point about tax incentives. The bullet is not invented. There is a real framework behind it, and it contains a tax holiday, a long land term, a residence permit and a waiver of the building approval.

We read that framework to answer one question: which of those is addressed to the person buying the property, rather than to the company building the zone. The answer is short, and the clearest statement of the confusion is published by the government itself.

What does a special economic zone grant, and to whom?

The statute makes a Government Regulation the instrument that creates any individual zoneSource: 1Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified, so the first document in a zone’s chain is a PP naming it. What that zone may then do has changed.

The 2009 statute listed seven zone types, tourism at letter e, no health class at all. The Cipta Kerja rewrite replaced it with eight classes of business activity — tourism at letter d, health at letter f, kept apart.Source: 2Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified The operating regulation lists thirteen kinds of activity, again with tourism and health as separate letters.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified That separation is the hinge: the dwelling provisions attach to one of those letters and not the others.

On housing the statute says almost nothing. Its only housing provision is one sentence permitting support facilities and housing for workers. Across the whole amendment block the word for housing appears once; dwelling, residence, hak pakai and freehold appear not at all.Source: 2Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified

The tax holiday is where the marketing starts, and it has an addressee. The corporate income-tax reduction goes only to a Badan Usaha or Pelaku Usaha investing in the zone’s Main Activity, on income from that activity — and the Main Activity is the business field that is the zone’s focus, fixed by the National Council.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified

The statute runs the same way: its income-tax facility belongs to a taxpayer carrying on business in the zone, and the article that once gave an investor a land-tax reduction was deleted outright by the Cipta Kerja amendment.Source: 2Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified The building-approval waiver has the same two addressees: no PBG is needed so long as the Badan Usaha has issued a building guideline or estate regulation.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified It reaches the developer and the operators, not whoever builds a house there — which matters, given who must demolish a villa built without one.

Which provisions mention buying a dwelling at all?

Two, and both say “tourism zone” in the first line. One article in the operating regulation is addressed to a purchase: buying a dwelling that is the Main Activity in a KEK Pariwisata is exempted from luxury-goods sales tax and from income tax on sales of very luxurious goods.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified Two exemptions, not a holiday, and both behind the corporate break’s condition.

The ministerial regulation splits that article in half and treats the halves differently. The income-tax half keeps the Main Activity condition and arrives as a certificate the buyer must obtain. The luxury-goods half covers any transfer of property in a tourism zone, without that qualifier, and is administered by the seller, who stamps the tax invoice to say the tax is exempted.Source: 4Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified

So the wider of the two is the one a buyer never touches. It arrives, if it arrives, as a stamp on someone else’s paperwork.

Which text prevails we cannot tell you. The ministerial regulation implements a Government Regulation that the 2021 regulation revoked, and survives only so far as it does not conflict with it.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified A wider ministerial exemption sitting on a narrower regulation is a tension between two texts, not a conclusion about which wins.

One thing we could settle. The only amendment on the finance ministry’s record, in force from 01.04.2021, runs to twenty-four numbered items and none reaches the dwelling articles: their numbers appear nowhere in it, against eight occurrences of the neighbouring article used as a control.Source: 5Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified The wording above is current.

The residence permit has the same boundary. A foreigner owning a dwelling in a tourism KEK gets a limited stay permit, or a permanent one by transfer of status, and the elucidation to that article sends the ownership itself back to ordinary legislation. The permit runs 5 years, extendable 5 at a time, with total stay in a zone not exceeding 15 years.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified It is the one place in Indonesian law where owning a home produces a permit, which is why buying a villa otherwise gives no right to live in Bali.

Where does the 80-year figure come from?

From the government. The National Council’s own incentive page offers, under its heading on land acquisition, hak pakai of up to 80 years and HGB of up to 80 years, marks the item valid for all activities, and cites the 2021 operating regulation as its legal basis.Source: 6Dewan Nasional Kawasan Ekonomi Khusus, Last reviewed Confidence: Verified

That regulation’s land article grants 30 years, extendable for 20 and renewable for 30. The word for eighty does not occur in the regulation; the word for thirty occurs fourteen times.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified The figure is the sum of the three steps — 30 plus 20 plus 30 — and the sum is ours.Estimate It is the arithmetic a leasehold pitch already runs on ordinary land, inside the zone meant to improve on it.

The steps carry conditions the page does not. Extension and renewal are granted once the Badan Usaha is commercially operating; a Pelaku Usaha’s term cannot exceed the Badan Usaha’s; and where the use right is aimed at owning a dwelling, they come once the dwelling is lawfully owned.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified

Then comes the article written for the foreign buyer, which is not the one the page quotes. In a tourism zone a foreign person may own a standalone dwelling built on a parcel held under an agreement with the holder of the land right, and gets either hak pakai for 30 years renewed on a consensus recorded in an agreement, or a strata unit over it.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified

The long ladder belongs to the zone’s companies. The foreign individual gets a flat term with no extension step, and a renewal resting on a future agreement — the signature nobody has given yet. Nothing here creates freehold for a foreigner.

The long ladder belongs to the zone's companies. The foreign individual gets a flat term with no extension step.
PP 40/2021, Pasal 142 read against Pasal 144

The same page states that foreigners may own property inside a KEK Pariwisata, and that a stay permit is available to the owner of a dwelling, with no qualification on either.Source: 6Dewan Nasional Kawasan Ekonomi Khusus, Last reviewed Confidence: Verified Neither sentence is false so much as unbounded: one calls a contractual right over someone else’s land ownership, the other drops the class of zone the permit depends on.

What does the government’s own register say about the two Bali zones?

The Council’s register entry for Sanur gives Kecamatan Denpasar Selatan in Kota Denpasar, the category Service, the legal basis Peraturan Pemerintah Nomor 41 Tahun 2022, the developer PT Hotel Indonesia Natour and 41.26 hectares, and its business-field listing carries a tourism group and a health group.Source: 7Dewan Nasional Kawasan Ekonomi Khusus, Last reviewed Confidence: Verified The entry for Kura Kura Bali gives Pulau Serangan in the same city, the same Service category, PP No 23 Tahun 2023, PT Bali Turtle Island Development and 498 hectares.Source: 8Dewan Nasional Kawasan Ekonomi Khusus, Last reviewed Confidence: Verified

A register is not a regulation. We did not obtain the text of the regulation the register names as Sanur’s legal basis: the finance ministry’s catalogue holds no record of it, and the national regulation database refused this desk with HTTP 403 on both its root and its search endpoint on 14.10.2026.Source: 12Badan Pemeriksa Keuangan Republik IndonesiaUnverified

So we cannot say what that regulation designates the zone as, and will not infer it from the zone’s name. We found no published instrument recording the Council’s determination of the Main Activity for either zone, so the condition both dwelling exemptions hang on cannot be tested.Source: 3Kementerian Keuangan, JDIHUnverified

What it does publish is a difference a reader can check. The tourism listing for Kura Kura Bali includes the activity code for real estate owned or leased. That code is absent from the Sanur listing, which carries the codes for venue hire and for real estate on a fee or contract basis.Source: 8Dewan Nasional Kawasan Ekonomi Khusus, Last reviewed Confidence: Verified Agency work is a different business from owning and selling dwellings, and the two zones sit on opposite sides of that line.

The local-tax half tells the same story. The regulation obliges the regional government to relieve local taxes for a Badan Usaha or Pelaku Usaha in a zone, requires that relief to cover at least the acquisition tax and the annual land tax, fixes it between 50 and 100 per cent, and sends the detail to a city by-law.Source: 3Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified

That by-law exists for one Bali zone. It sets the annual land-tax reduction at 80 per cent in the first two years, then 75, 65 and 50 per cent, applies the same scale to the acquisition tax, and fixes the zone at 498 hectares in Kecamatan Denpasar Selatan.Source: 9Bagian Hukum Sekretariat Daerah Kota Denpasar, JDIH, Last reviewed Confidence: Verified But the operative limb gives the relief to a developer or operator that both owns the taxable object and carries on business in the zone.Source: 9Bagian Hukum Sekretariat Daerah Kota Denpasar, JDIH, Last reviewed Confidence: Verified Owning the property is half the test. The unreduced taxes are in how Badung taxes a villa and in whether acquisition tax applies to a lease.

A title search of the city’s published catalogue for the words meaning special economic zone returned two instruments, and both name Kura-Kura Bali.Source: 11Bagian Hukum Sekretariat Daerah Kota Denpasar, JDIH, Last reviewed Confidence: Verified Its general investment-incentive by-law of December 2025 does not fill the gap: it names no zone and no dwelling, defines the public beneficiary as Indonesian citizens carrying on business, and makes an applicant bring a company profile and a business plan to the Mayor.Source: 10Bagian Hukum Sekretariat Daerah Kota Denpasar, JDIH, Last reviewed Confidence: Verified

The case against this reading

Five limits, and the first could overturn the frame rather than soften it.

The designating regulation is the document we could not open. A designation can be amended, and can carry more than one class of activity — the council’s listing for Sanur carries tourism codes as well as health ones. If tourism is among the designated activities, the tourism articles are in play exactly as the marketing says, and the threshold question is answered against us. What those articles deliver would not change: a seller-administered exemption, a certificate conditioned on the Main Activity, a capped permit, a flat term. But the sentence naming what this zone is designated as is one this desk cannot write.

The register is evidence of the register. The activity lists we compared are published on the council’s investment pages. We do not know they are the formal determination the regulation requires, and have not treated them as such: they are the government’s description of what each zone is for, not a legal instrument.

An absence in a catalogue is not a prohibition. Our negative findings are bounded by where we looked: two city instruments, one investment by-law, a national catalogue holding no zone-establishing regulation at all, and a national database that refused us. Web search was unavailable throughout.

Operative text and elucidation are not the same authority. The strata-title article in the Cipta Kerja annex lets a permit-holding foreigner own a strata unit, with no geographic limit in the article itself; the confinement of that right to special economic zones appears only in the elucidation.Source: 2Kementerian Keuangan, JDIH, Last reviewed Confidence: Verified An elucidation interprets, it does not enact. The numbers also collide: the annex has its own Pasal 142 and Pasal 144, and so does the operating regulation — which is why every citation above names its instrument.

We read texts, not practice. Whether a zone administrator issues exemption certificates to individual buyers is in no document we have. The pattern is familiar from structures where the instrument is clear and what happens to the money when it is void is the real question.

What to ask before paying a zone premium

Ask in writing for the number and date of the Government Regulation that established the zone, and for the Council’s determination of the Main Activity. Those two documents decide whether any dwelling provision applies, and a seller relying on them should be able to produce them.

Ask whether the party selling to you is the Badan Usaha, a Pelaku Usaha, or neither. The tax reduction, the building waiver and the long land ladder are written for the first two. If it is neither, ask which facility is being described to you as yours.

For the luxury-goods exemption, ask to see a draft tax invoice carrying the exemption stamp: that stamp is the whole mechanism, and there is nothing else for a buyer to hold. For the income-tax exemption, ask who applies for the certificate, and on what evidence the purchase is the Main Activity.

We read the statute, the operating regulation, the ministerial regulation and its only amendment, two city by-laws and both register entries as those bodies published them on 14.10.2026. The operating regulation’s text layer substitutes characters systematically, so every term of years and percentage above was read against the Indonesian spelled out beside it.
